Congress Should Move On Biosimilar Bills To Lower Drug Costs For Families

ARLINGTON, VA — The LIBRE Initiative and Americans for Prosperity today sent a joint letter to House Energy and Commerce Committee Chairman Brett Guthrie (R-KY) and Ranking Member Frank Pallone, Jr. (D-NJ) urging a “yes” vote on three bipartisan bills set for committee vote next week that would lower prescription drug costs by removing government-created barriers to biosimilar competition. 

The three bills — the Biosimilar Red Tape Elimination Act (H.R. 5526), the Expedited Access to Biosimilars Act (H.R. 9661), and the STOP GAMES Act of 2026 (H.R. 8908) — each target a specific regulatory or legal obstacle that delays lower-cost biosimilar drugs from reaching patients. Together, they represent impactful, market-driven steps Congress can take to address the cost-of-living challenges hitting American families at the pharmacy counter. 

Biosimilar Red Tape Elimination Act (H.R. 5526) eliminates duplicative switching-study requirements for interchangeability determinations that add years and unnecessary cost to biosimilar development without improving patient safety. 

Expedited Access to Biosimilars Act (H.R. 9661) ends the default requirement for costly clinical efficacy studies before biosimilar licensure, aligning FDA practice with the scientific consensus that analytical and pharmacokinetic data are sufficient to confirm biosimilarity. 

STOP GAMES Act of 2026 (H.R. 8908) closes the loophole that brand manufacturers exploit to file meritless citizen petitions solely to delay approval of competing generics and biosimilars.

Our polling confirms that belief remains strong: Latinos want solutions that expand access and lower costs, not more government-created barriers standing in the way. The letter, signed jointly by Garza and Gardner, underscores the growing coalition of organizations committed to lowering healthcare costs through competition and market-driven reform rather than new government mandates, taxes, or subsidies.
